A Failing System: The Inadequacy of “Best Interests of the Child” in Modern Child Welfare

The contention of the presenter is that the concept of “best interests of the child” has little meaning in the modern child welfare system. Children’s best interests have been replaced with a system of care that has little regard for the individual child. Parens patriae is the governing concept of how we protect American children from harm, but this concept relies upon a cold, impersonal governmental system to care for children. How can we move forward and eliminate the mistakes of the past to provide care for children that does no more harm than the situations where they experienced abuse and neglect? What are modern solutions for restoring families and minimizing exposure to the foster care system for children? This presentation will move from antiquity to modernity in how we can approach these challenges.
